Terms of Service

1. Acceptance
By using the FrightMaps app or frightmaps.com (the “Service”), you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
2. The Service
FrightMaps helps users discover haunted houses and Halloween displays, plan routes, buy and sell event tickets, enter contests, and control compatible decorations. Features may change over time.
3. Accounts
You’re responsible for activity under your account and for keeping your login secure. Provide accurate information and keep it current. You must be old enough to form a binding contract in your jurisdiction.
4. Your content & listings
You retain ownership of content you submit (house listings, photos, descriptions). By submitting it, you grant FrightMaps a non-exclusive, worldwide license to host, display, and promote it within the Service. You represent that you have the rights to the content and that it is accurate and lawful. We may review, approve, or remove content that violates these Terms.
5. Ticketing
FrightMaps operates a ticketing marketplace. The haunt or event operator (the “Organizer”) is the seller and merchant of record for every ticket; FrightMaps acts only as a technology and payment facilitator that lists the event, processes the transaction through Stripe, and delivers tickets. The contract for the event is between you and the Organizer.
5.1 Ticket purchases & refund policy (buyers)
- All sales are final unless the Organizer’s stated policy or applicable law provides otherwise. Each event displays the Organizer’s refund and exchange policy at checkout; that policy governs your purchase.
- Tickets are delivered electronically (typically as QR codes) to the email used at checkout and may also appear in the FrightMaps app. You are responsible for entering a correct email address.
- Tickets admit the number of people stated and are valid only for the specified event, date, and time slot. Unless the Organizer permits it, tickets are non-transferable and may not be resold above face value.
- Service and payment-processing fees are generally non-refundable even when the ticket price is refunded, except where required by law.
- Event changes & cancellations: if an Organizer reschedules or cancels, the Organizer is responsible for honoring its refund policy. Where a cancelled event is not honored, FrightMaps may, at its discretion, facilitate a refund of amounts still held on the Organizer’s behalf, but does not guarantee refunds beyond funds actually recoverable from the Organizer.
- Admission may be subject to the Organizer’s and venue’s rules, including age restrictions, capacity, weather, safety, and conduct requirements. Haunted attractions can be physically intense; you attend at your own risk and must follow posted rules and staff instructions.
- Chargebacks: please contact the Organizer or FrightMaps support before disputing a charge. Filing a chargeback for a ticket you used or for an event that was held as described may result in account suspension and recovery of the disputed amount and associated fees.
5.2 Organizer / Seller Agreement
If you sell tickets through FrightMaps, the following terms apply to you in addition to the rest of these Terms:
- Your responsibility for the event. You are solely responsible for your event and listings, including descriptions, pricing, dates, capacity, time slots, age and safety requirements, staffing, insurance, and any permits, licenses, and taxes required to operate and to sell tickets.
- Payments & Stripe. You must connect a Stripe account to receive payouts. By onboarding, you agree to the Stripe Connected Account Agreement and the Stripe Services Agreement, and you authorize Stripe and FrightMaps to act as described there and here.
- Fees & payouts. You authorize FrightMaps to deduct the disclosed per-ticket service fee and payment-processing fees from ticket sales. Payouts settle to your Stripe account on Stripe’s standard schedule. You are the merchant of record and are responsible for sales tax and any other applicable taxes on your sales.
- Honoring tickets & refunds. You must honor every valid ticket and deliver the experience you advertise. You set and must follow your own refund policy, and you are responsible for issuing refunds owed to buyers — including full refunds when you cancel an event. You authorize FrightMaps to process refunds, reverse payouts, and withhold or recover funds and fees to cover refunds, chargebacks, fraud, or violations of these Terms.
- Reserves & holds. FrightMaps may withhold, delay, or reserve payouts where reasonably necessary to cover anticipated refunds, chargebacks, disputes, or risk, including for new Organizers or events dated in the future.
- Prohibited events. You may not sell tickets to unlawful, fraudulent, unsafe, or misrepresented events, or to events you are not authorized to operate.
- Suspension. FrightMaps may remove listings, pause sales, or suspend payouts for events that appear fraudulent, unsafe, non-compliant, or subject to excessive disputes.
- Indemnification. You will indemnify and hold FrightMaps harmless from claims by buyers, attendees, authorities, or third parties arising out of your events, listings, tickets, refunds, or your violation of these Terms or applicable law.
6. Payments, fees & subscriptions
Payments are processed by Stripe and the app stores. Ticket sales may include a per-ticket service fee plus payment-processing fees, which may be absorbed by the Organizer or passed to the buyer. Paid subscriptions (e.g., Pro) and advertising are billed through the applicable store, RevenueCat, or Stripe, and recurring plans renew automatically until canceled. Manage or cancel subscriptions where you purchased them.
7. Acceptable use
You agree not to:
- Post false, infringing, harmful, or unlawful content or listings.
- Misrepresent events, sell tickets you can’t honor, or defraud buyers.
- Interfere with, scrape, or attempt to disrupt or reverse-engineer the Service.
- Use the Service to harass others or violate others’ rights or applicable law.
8. Listings & third-party content
Haunt locations, events, and other content are provided by users and Organizers. We don’t guarantee the accuracy, availability, safety, or quality of any listing or event, and we’re not responsible for interactions between users and Organizers.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We don’t warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, FrightMaps will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the prior 12 months or $100.
11. Indemnification
You agree to indemnify and hold FrightMaps harmless from claims arising out of your content, your events, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access that violates these Terms or harms users or the Service.
13. Governing law
These Terms are governed by the laws of the State in which FrightMaps is organized, without regard to conflict-of-laws rules. (Confirm the specific jurisdiction with counsel.)
14. Changes
We may update these Terms; we’ll revise the “Last updated” date and, for material changes, provide notice.
